Fishing vessel port-base setting and change regulation updated

The Council of Ministers approved a new Royal Decree that will regulate the setting and change of base port of fishing vessels, proposed by the Ministry of Agriculture and Fisheries, Food and the Environment (MAPAMA).
The new decree modifies certain aspects of the Royal Decree 1549/2009, dated October 9, specifically those relating to certain provisions of temporary implementation, which will have an unlimited duration.
The approved Royal Decree sets the principles governing the first setting of a base port when a fishing vessel is incorporated for the first time into the fishing activity as well as the successive temporary or permanent changes of base port taking place throughout the ship life. It also sets the separation of powers between the autonomous communities and the MAPAMA.
On the other hand, it foresees the regulatory development of the conditions in which the ships can use a different port from the one whose base is fixed.
The setting process of the base port of a fishing vessel will be governed by the principle of free choice, although subject to certain conditions that ensure the proper practice of the fishing activity.
The Royal Decree expressly takes into consideration the power of the Ministry of Development and the port authorities in this matter, establishing when a report should be required from said Administrations.
On the other hand, the Royal Decree on the management of the fishing sector is modified in specific elements in order to incorporate indefinitely a series of regulations that have been added in recent years with a temporary validity, upon finding that they have been beneficial for shipowners and fishing companies.
The measures include permits for deregistering for construction, updating, import and regularization. In particular, it is allowed that when a ship is deregistered, its fishing capacity can be divided into several contributions. Each withdrawal contribution may be made up to one year after a ship is exported or damaged.
This new regulation also contributes to the processing of files and their terms are extended.
