Judiciary approves Argentinean shrimp imports

The Federal Court of the Federal District disregarded the request of the Brazilian Association of Shrimp Breeders (ABCC) intended to prevent entry of the shrimp (Pleoticus muelleri) native to Argentina into the domestic market.
Federal judge Márcio de França Moreira, spoke in favour of the Argentinean shrimp import, determined by the governments of both countries.
After learning about the judiciary’s ruling, the ABCC announced they would appeal to the Federal Court of Brasilia itself.
According to França Moreira, the Argentinean shrimp import ban "constitutes a covert discriminatory measure for international trade, with a clear unjustified protectionist intention of the national product."
The judge believes the ABCC has failed to demonstrate the existence of research or of scientific articles that prove the incidence of diseases such as the white spot and the hematopoietic necrosis in wild shrimp of Pleoticus muelleri species caught in waters in Argentina.
However, ABCC president, Itamar Rocha, ensured they are going to appeal.
"If the decision had been favourable to the Association, I am certain that the Ministry of Fisheries and Aquaculture would appeal," stated the businessman, according to the newspaper Tribuna do Norte.
Shrimp import has been banned since 1999, but in December 2012 the federal government initiated a risk analysis on shrimp import in order to approve the entry of this resource to the country.
In his opinion, Judge França Moreira stressed: "Brazil is a signatory to the World Trade Organization and pledged to implement non-discriminatory protectionist measures that favour domestic products against foreign competition and, consequently, prevent free trade among member countries."
The judge decided to allow the entry of Argentinean shrimp in the Brazilian market as it is considered there is not enough scientific evidence to suggest a possible risk to human health and to the shrimp produced in the country.
In this regard, he stressed that the available studies categorically ensure that the existing diseases in shrimp species "are not pathogenic to humans."
The MPA has not stated yet when the first Argentinean shrimp import will take place.
