Environmental Court admits Los Fiordos reclaim over USD 3 million fine

The Third Environmental Court admitted a claiming procedure carried out by Exportadora Los Fiordos against the Superintendency of the Environment (SMA), for violations in 18 farms of the company located in the Canal de Puyuhuapi, Aysen Region.
Specifically, the presentation is directed against the Exempt Resolution No. 994 of the SMA issued on 28 October, 2015, by which a fine amounting to 4,143 annual tax units (about CLP 2,226 million/USD 3.1 million) applies.
Among the violations of the environmental and health regulations sanctioned by the SMA, those included are setting nets in sectors near acquaculture farms; residues from the activity in the seabed and surrounding beaches; improper disposal of information on salmon mortality, and subsequent runoff of organic material into the environment; overproduction in the Farming Centre Bahia Anita; cage rafts and platforms outside the concession area, among others.
In its submission, Los Fiordos argues that the exempted resolution "is contrary to law and causes a serious damage" to the fined firm so it requires the Court based in Valdivia "to rescind that decision." In addition, it requested conducting a "personal inspection to the centres in dispute", which was rejected by the Court "as regards the procedural status of the case and the fact that the requested measure is deemed as a faculty of the Tribunal".
The resolution of the Third Environmental Court requests the SMA to inform about and send the administrative file that gave rise to the claim within 10 days.
